Anyone have any problems with fake Cuban rum in Mexico and if I transfer into a Bacardi bottle and declare it as such, isn't that technically the truth?

No, it is not legal to bring Cuban rum or cigars into the US. Every citizen can bring back 1 liter of booze, duty free, but that does not allow for banned spirits.
