I think that the copyright on most of the Early Exotica and Tiki recordings is more than "Past it's Sell By Date" i.e. the Artist's permission is no longer required nor the record company's, the copyright on the actual song/tune, is a different matter though. This topic comes up on a regular basis, some people are under the impression that the composer's permission is required to commercially record a tune/song.. NOT TRUE once the song has been performed in public, it doesn't even need to have a prior recording made. A public performance of a song opens up the material to everyone's use, PROVIDED they pay the correct fees to the appropriate agencies. AND the copyright laws of the USA and Europe are quite different, which in itself poses a problem, not for the poster but for the viewer/recipient as to the legality of downloading. To post material HERE (On the Web) for "Educational and Research" purposes is a grey area, but generally (Unless you rip off some pretty new ORIGINAL material) a blind eye is turned to such practises. See this EMI Document circulated to all artists recently :- As an aside this is what EMI say to their artists about "On Line Sales" |
