Make a decanter from a picture?

Gang,

I have a picture of a one-of-a-kind ceramic decanter that I can't get. Can anyone suggest a company/artist that could create an exact replica for me, working off the photograph I have?

I could make the decanter (one?) and send you a bisque decanter back. One of MY best talents is making copies of things.

Um, wouldn't this be the same thing that City Buddha is doing to Paipo and all those other NZ carvers? It is plagiarism unless the person making the copy is keeping it for themselves, or has permission of the original artist to make copies.

Okay, let's get to the bottom of this, here and now, where is the line? Is there a line? Grey area or sharp line? Who gets to decide? What is the high road and what is law?

I agree that copying Paipo's stuff is way over the top. All the talk of intellectual property and copyrights gets me confused, it often seems that the person who has something to lose, makes up rules as they go, then suddenly there is law to that effect. (Don't get ,me started with Architects...you pay for the plans out the wazoo and they still claim ownership, nice work if you can get it...)

Why don’t you post the picture to see if we recognize it. It may be available or someone may want to make a trade with you. Intellectual Property is an animal all to itself with its own kind of Lawyer.

Trademark is something completely different, and again has its own kind of Lawyer.

Copyright is easier to manage because it has been around the longest, has the most clearly (hah!) defined parameters, and has had many court-tested cases to have a legal precedent to draw upon.

To apply it to Tiki as a concept.....

the Heitiki image is old enough, and far enough back in history as to be fair game to reproduce. If you want to carve a Heitiki no one can come after you and claim you copied them. No one 'owns' the Heitiki image any longer. (Cultural ownership is a different conversation)

However, if you take my Heitiki carving, create a mold of it and start selling duplicates of it, that is not cool. And if I can prove that they are copies of my carving I can sue for lost revenue.

Jeez folks, why is that so hard to see? Isn't it obvious that there is a difference between a commercial company mass-producing copies of Paipo's designs and selling them, to a single fellow wanting to have ONE made, for his own personal use? It's just a friggin' pitcher, not the Mona Lisa!

How do we know he is single? Do you have to be single to make copies?
Oh Hell, I'm more confused than before.

So if I make a copy of BOT for myself, That's alright? Why won't Kinkos do color copies of the BOT when I tell them it's just for me? Can I make 10 copies just for me? I have a lot of bathrooms, and then there is the bathrooms at the studio, I want a copy there, can I do that? It's just for me...
HEY! What about the pictures inside the BOT...did bigbrotiki get permission for all those pictures? And because it's tri-lingual, did he get permission in those countries as well? No wonder it was so expensive!
Okay, all kidding aside, I found a TiKi at flea market, it appears to be a soft ceramic material like plaster, I paid $2.00 for it and there are no markings on it at all, I have never seen this figure before and I want to copy it, maybe sell some. Okay? I don't give a rip what the legal beagles have to say, I just don't want to be ripped by a TCer.
