What about the 40% rule?

I could see if the image was trademarked but in the case of art isn't there a 40% rule that if the representation has changes up to 40% it is a stand alone piece of artwork? Would the medium play into that as far as illustration vs. clay ? Although it is no doubt a likeness, a copy even, it is still a representation of the original.

For me, I think somebody has a cool Dad and it doesn't sound like a wholesaler or retailer type of threat.

It may have been a bit ....audacious to ask the artist to sign a card. I think one should always tread lightly and be mindful of artists and their artwork. But I can understand being proud of the gift your dad made for you. How many Dads actually take the time to make things for their kids birthday these days? Snaps to Dad.

I have started to carve Tikis and some of the ones I carve are very much influenced by another carver who has passed on. An Influenced by & in Memory of: tribute card recognizing this fact accompanies every carving of that style. ( not that I have ever sold one, I mostly give them away ) But while these carvings may have been influenced by anothers work they still vary with my own additions and influences and I consider it a style that I continue in my own fashion rather than "I ripped somebodies work".

I think it is easy to misinterpret things said in letters and posts in a forum. One cannot delve the inflections or connotations of a statement as well as if talking on the phone or in person. It leaves allot of blanks for the reader to fill in. I bet if the original correspondence had taken place by phone or in person it would have turned out much different.

I feel this is a good conversation for the Forums. It's a good topic for artist's and craftsman to discuss, understand and opine upon. As long as everybody plays nice and are not malicious and conducts themselves as a tempered adult. I, for one, would like to understand better the copyright issues of artwork.

It looks like somebody was influenced by someone elses work here. I'm sure they were paid for it.
Was this a copyright infringement? I mean they painted it by hand.... I would be curious to know how the original artist would view it. How do you see it?
