My gaaahd! Look at all the crap they've trademarked!! Tiki Kids™, Tiki Dolls™, Tiki Heads™, Tiki Bird™, Tiki Toy™, Tiki Toons™ Can you trademark "tiki stuff"?"tiki lifestyle"? Why not "tiki bar"? I'm sure those b*stards tried to. Jimmy Buffet probably already owns it. And Baxdog has (had) the original "tiki city" in his backyard! And Tiki King is married to "Tiki Queen" already! Vintage Girl already defines "Tiki fashion"! Do we need to hurry up and trademark "tiki carving"?"tiki statue"?"tiki fun"?"tiki drink"?"tiki sex"? -oops, scratch that last one. But on a serious note, Hanford, do we (you) have protection for "Tiki Central" and "Tiki room"? Or might those freaks try to make us pay the above-mentioned "tiki royalties" for the right to exist in cyber-space? |

Ok..here's what I found out (I called)... Well, first I went to the Tiki Queen Yahoo Group. It lists and refers to "TikiQueen.com" at the bottom. So I went there. As you see on TikiQueen.com, it then refers to a company called "Tiki Media". It then lists a toll-free number at the bottom to a media group, which I called.... While on hold, they had Hawaiian music playing, and then on comes "Eric". I spoke with him and asked what Tiki Queen, Tiki Media and all the Tiki names listed on the Tiki Media site were all about. He said that they are a "holding company" and are attempting to work with different restaurants and nightclubs in order to put on various tiki related projects and products. Products?? He said that these products were under development. He was very vague, of course, not wanting to release any more info than needed. Hmmm....ok. So I repeated back to him for absolute clarification and I said "so, you are trying to develop interest in tiki through restaurants and (night)clubs to generate interest in your "product", which you say is "under development". He said "Yes, that's it". Note, that if you type in any of the names on the TikiMedia.com website and add ".com" to it, it brings you right back to Tiki Media. I take it that he has registered all of these names for future sales of them to interested parties. I asked him what their goal for this investment is. He said he hopes to bring out some of the 'closet tiki' people. I then asked him if he was into tiki, hawaiiana, etc., and he said "sure". I asked if he has gone out to ANY of the the tiki functions currently going on in Southern California (they are based near LAX). He said no. He's a closet tiki person himself. I asked him if he knows any carvers. He said no. When I mentioned Sven's name, it seemed to fly right over his head. The more I asked about tiki-related things the more I felt that he had no background knowledge whatsoever and was just jumping on the bandwagon. Now, I work in marketing & media myself, and I don't think I quite agree with the approach they are taking to spearhead a project like this. Especially if he is "in the closet". Sheeesh. He said that they(?) will probably have more info up on their site after January 2004. We'll see if this person finds us here. I didn't mention Tiki Central at all since I want to see if this guy can actually do research and find us here. This sound like just another cyber-squatter hoping someone'll pay him for the rights to the domains he's registered. He's just gone a little further than most in trademarking his "products." His trademarks'll probably fall to anyone who's can show prior usage of any of the Tiki etc. trademarks. He may lose the rights to register the related domain names as well. |

Much to my chagrin, I was looking through the list and saw TikiTrader listed as DEAD. I checked the info, and saw the name of the owner. I realized it was the same person i had recently bought an item from on ebay, which I have yet to receive. So BEWARE, TikiTrader is now doing business on ebay as HAWAIIANSTYLE55 |

^I can attest to the fact taht HAWAIIANSTYLE55 is a con artist. I bought a black velvet painting from the guy in July. He never sent it, and hasn't responded to emails since August. At that point he was claiming the delay was due to a computer problem. I had to go through my credit card company to get a refund. |

You can trademark any name you want, but that doesn't mean the court will uphold your right to protection or compensation. To trademark a name that is enforceable it must be unique and not a commonly used name or description. I doubt the proprietary rights to a term like "tiki restaurant" could be successfully defended in court. In fact, the more we use the terms this person has trademarked to describe generic objects or activities that are not specific to a commercial activity, the less protection they have. Also, anyone can put a TM next to a term without actually having registered it. Of course, I favor a hit on this person anyway -- just because their tiki groupTM is so obnoxious. This media group apparently just added the "tm" to all the names. The names don't seem to be currently trademarked. They may run into some trouble with Mattel over the name "TikiBlaster(s)" since this is a current Mattel trademark, and we know that Mattel has more than enough money to run this guy/person/group down over the name. The following is the current filings of names with tiki in it, either "dead" or "alive" (active/inactive). Note, that you will see some names repeated. Because you can register a name within (I believe 40+) categories and classifications, you can use the same name but within it's own classification. ex.: WITCO is registered currently for a detergents company, a trucking company, a metal containers company and an organic surfactants company, all, of which would be in different business and usage classifications. This is why in registering a trademark (or sidemark) you should really consult with a specialist in the trademarking field. Trademarks are generally the brand name, logo, or symbol given to uniquely identify a consumable good. You can't just start up a list of words or phrases, label them as 'trademarked', and instantly own the rights. Words or other symbols have legal protection as soon as consumers see them as representing unique commercial sources. Registering these tiki names as internet domains gives them the right market that domain name, but it doesn't necessarily create a trademark. For example, if a hot dog stand recently opened under the name "Trader Pup", that would effectively become their trademark. Even though I own the domain name Traderpup.com, I couldn't do much to stop them from using it, unless my website represented my business. And then it gets tricky, as different businesses can have the same trademarked name, if they are in very unrelated industries. Consumer recognition also plays a role in that, as there could be both a Trader Pup hotdog stand, as well as a Trader Pup pet grooming service, without trademark conflict. But I wouldn't be able to open the Coca Cola Pet Grooming Service, as Coca Cola is a highly recognized trademark. This is the part where lawyers get really important. Registering your trademark gives you legal advantages, basically giving your trademark seniority over non-registered trademarks. It can be done on a state or federal level. But with registration fees upwards of $1000, and that is not including any legal fees you may incur, few small business bother with registering. Anyone can use 'TM' after their business name or logo, but only registered trademarks can use the 'R' in a circle. Unless this media group has registered these "tiki" names, they are still pretty much up for grabs by other businesses. Whew Then nobody else is gonna have much success at trying to Trademark "Formikahini" as a minor&fake celebrity/exotica musician/Ebay Hawaiian dress junkie/shameless flirt/mug collecter, because I myself pretty well have the already recognizable handle on that one. But some one COULD start up "Formikahini Home Mold Removal" or "Formikahini Leaf- Blowing Service" or "Formikahini Transmissions"? I guess that's ok... (What I want to steal, however, is from that list: D*MN! WHAT A GREAT IDEA!!!! I'm so jealous!!) |
